RIGHT OF WITHDRAWAL FOR CONSUMERS, WITHDRAWAL POLICY

If you are a consumer within the meaning of § 13 BGB, you are entitled, subject to the regulation in Section 4.4 of our GTC, to a right of withdrawal pursuant to § 312 g para. 1 BGB under the following conditions:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods. If goods of a single order are delivered separately or in several partial shipments or pieces, the withdrawal period begins upon receipt of the last partial shipment or the last piece of the goods.

To exercise your right of withdrawal, you must inform us, R&K Verpackungswelt GmbH, Goldkäferweg 55, D-22523 Hamburg, Fax: +49(0)911/93196-35, Email: service@verpackungswelt.de, by means of an explicit declaration (e.g. a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (except for additional costs arising from your choosing a type of delivery other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day we received the notification of your withdrawal from this contract. For this refund, we will use the same payment method you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this refund. We may refuse to issue the refund until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us, R&K Verpackungswelt GmbH, Warehouse address: Lenkersheimerstr. 26, D-90431 Nuremberg, without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss of value is due to handling of the goods that was not necessary to check their quality, characteristics, and functioning.

The sample withdrawal form referred to as “attached” above is made available to you at the end of these instructions on withdrawal as a download. If you wish to withdraw from the contract, please print out and complete this form and return it to us as described.

The above right of withdrawal does not apply to you as a consumer within the meaning of § 13 BGB (see definition in Section 1.2 of our GTC) if the goods you ordered are not prefabricated and have been manufactured according to your individual choice or specification, or are clearly tailored to your personal needs (§ 312g para. 2 sentence 1 no. 1 BGB).

For customers who are consumers within the meaning of § 13 BGB (see definition in Section 1.2 of our GTC) and have their habitual residence in a country that is neither a member of the European Union (EU) nor of the European Economic Area (EEA), the above right of withdrawal does not apply. However, the consumer protection law of the country in which the customer has their habitual residence at the time of the conclusion of the contract with us may apply additionally.

For customers who are entrepreneurs within the meaning of § 14 BGB (see definition in Section 1.2 of our GTC), the above right of withdrawal does not apply. This does not affect the entrepreneur’s warranty rights under our GTC.
